Terms of Service — Poultry Cartons, LLC
Effective Date: February 14, 2026
These Terms of Service (“Terms”) govern your access to and use of the Poultry Cartons website (the “Site”) and any purchase of products from Poultry Cartons, LLC (“Poultry Cartons,” “we,” “us,” or “our”). By using the Site or placing an order, you agree to these Terms.
If you do not agree, do not use the Site or purchase products from us.
1) Company Information
Poultry Cartons, LLC is the seller of record for purchases made through the Site.
2) Changes to These Terms
We may update these Terms from time to time. The “Effective Date” above indicates when the Terms last changed. Changes apply to Site use after the Effective Date. Purchases are governed by the Terms in effect at the time the order is placed.
3) Eligibility
You must be able to form a binding contract to use the Site and purchase products.
4) Orders, Order Acceptance, and Cancellations
- Order acceptance. Your order is an offer to purchase. We may accept or decline an order for any reason, including availability, suspected fraud, errors in product or pricing information, or shipping constraints.
- Order cancellation by us. If we cancel an order after you have been charged, we will issue a refund for the canceled items/amount.
- Customer cancellations. If you need to cancel, contact us promptly. Once an order has been processed or shipped, cancellation may not be possible and your request will be treated as a return (subject to our Return Policy).
5) Pricing, Product Information, and Availability
We strive to display accurate product information, but errors may occur (including pricing, descriptions, images, and availability). We reserve the right to correct errors and to change or update information at any time without prior notice. If a material error affects your order, we may cancel the order and refund any amounts paid.
6) Payments
By providing payment information, you represent that you are authorized to use the payment method. You authorize us (and our payment processors) to charge the total amount due, including shipping and taxes (if applicable). We may use fraud-prevention tools and may request additional verification.
7) Sales Tax
We collect sales tax where required by law, based on the shipping destination and applicable tax rules. Tax is generally calculated at checkout.
8) Shipping, Delivery, International Orders
- Where we ship. We ship to addresses globally where carriers service the destination and the shipment is lawful to transport.
- Shipping timelines. Transit times are estimates and not guaranteed.
- International duties/taxes. For international shipments, you are responsible for duties, import taxes, brokerage fees, and other charges assessed by the destination country unless explicitly stated otherwise at checkout.
- Customs restrictions. You are responsible for confirming that the destination country permits import of the products ordered. If a shipment is refused, unclaimed, or returned due to customs issues or unpaid fees, additional shipping charges may apply for reshipment.
Title and risk of loss. Title and risk of loss pass to you upon our tender of the shipment to the carrier; however, we will work with customers in good faith to resolve confirmed in-transit loss or damage consistent with the reporting timelines in Section 10.
9) Returns (RMA Required; Time Limits)
We accept returns on most products except:
- Vintage egg cartons
- Duck egg cartons
To be eligible for a return, items must be unused and in original condition.
Return request window (7 days): You must request a return within 7 days of delivery.
RMA required: All returns require a Return Merchandise Authorization (RMA) before items are shipped back. Returns shipped without an RMA may be refused.
Ship-back deadline (7 days): Once your return is approved and an RMA is issued, items must be shipped back within 7 days of approval.
Return shipping costs: Customers are responsible for return shipping costs. We recommend using a trackable service; we are not responsible for loss or damage to return shipments.
We may deny returns or reduce credit if returned items are not in original condition or are missing components.
10) Damaged, Missing, or Incorrect Items (Report Within 72 Hours; Replacement)
If your order arrives damaged, missing items, or contains an incorrect item, you must notify us within 72 hours of delivery.
To help us resolve the issue quickly, we may request:
- order number,
- a description of the issue, and
- photos of the outer box, shipping label, internal packaging, and affected items.
Resolution: At our discretion, we will replace damaged, missing, or incorrect items (rather than refund), subject to product availability. We may require return of affected items/packaging to support carrier claims.
11) Use of the Site; Prohibited Conduct
You agree not to:
- use the Site for unlawful purposes,
- interfere with Site operation or security,
- attempt unauthorized access to systems or accounts,
- scrape or harvest data without permission, or
- submit false or misleading information.
12) Intellectual Property
The Site and its content (including text, images, graphics, logos, and design) are owned by Poultry Cartons or its licensors and are protected by intellectual property laws. You may view and use the Site for your personal or internal business purposes in connection with purchasing from us. You may not reproduce, distribute, publicly display, or create derivative works from Site content without our prior written permission.
All trademarks and brand names are the property of their respective owners. Reference to third-party products or services does not imply endorsement.
13) Third-Party Links and Services
The Site may link to third-party websites or services. We do not control and are not responsible for third-party content, policies, or practices.
14) Disclaimers
THE SITE AND ANY CONTENT ARE PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
Some jurisdictions do not allow certain disclaimers, so some of the above may not apply to you.
15) Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, POULTRY CARTONS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS OR REVENUE, ARISING OUT OF OR RELATED TO YOUR USE OF THE SITE OR PURCHASE OF PRODUCTS.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATED TO THE SITE OR THESE TERMS WILL NOT EXCEED THE AMOUNT YOU PAID TO US FOR THE PRODUCT(S) GIVING RISE TO THE CLAIM.
Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.
16) Indemnification
You agree to indemnify and hold harmless Poultry Cartons from and against claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising out of your violation of these Terms or misuse of the Site.
17) Governing Law; Venue
These Terms are governed by the laws of the State of North Carolina, without regard to conflict-of-law principles. You agree that any dispute arising out of or relating to these Terms or your purchase will be brought in the state courts located in North Carolina, or the United States District Court for the Middle District of North Carolina, and you consent to personal jurisdiction in those courts.
18) Severability
If any provision of these Terms is held invalid or unenforceable, the remaining provisions remain in full force and effect.
19) Entire Agreement
These Terms constitute the entire agreement between you and Poultry Cartons regarding the Site and purchases and supersede prior or contemporaneous communications related to that subject matter.
